Reddit TL;DR: no real news yet but there are some answers and maybe even hopeful signs that there will be enough assets to pay customers back at least some portion of their funds by the summer of 2023.
ACTIONS TO TAKE from M11 - :
I’m not an attorney; however, this post is specifically aimed at documenting all steps Celsius depositors should take to protect their claims on assets held in Celsius now that Chapter 11 bankruptcy is confirmed (not financial or legal advice of course).
- Save your proof of funds with Celsius
A) Take a screenshot of your Celsius account values
B) Export and save your Celsius transaction file. Because it’s a .csv file, never edit it in order to preserve the timestamp.
C) Send an email to Celsius requesting a “Proof of Funds” document for your account. - In order to ensure that your assets in Celsius are correctly accounted for in bankruptcy proceedings, you must REMEMBER to submit the “Proof of Claims” document once the motion comes out.
Below is a link to a Reddit post by virussc claiming to be a bankruptcy attorney who worked on the Cred [cryptocurrency] bankruptcy case in 2020. He explains the process in amazing detail, I highly recommend you check out his posts on the subject:
Celsius Bankruptcy Reddit Post 12
These are my takeaways from his posts:
A) You need to remember to submit the Proof of Claim once the motion becomes available. Schedules may be incorrect and if so, Proof of Claim, is the only thing that can protect against this.
B) Once you submit a Proof of Claim, your personal information will automatically become public record in most cases. In the Cred case, special accommodations were made to protect the anonymity of the creditors, which is why he recommends waiting for the motions to be ordered prior to submitting the Proof of Claim if privacy is of concern (which it definitely should be in crypto).
C) Timeline. The bar date (notification to everyone the date in which proof of claims need to be filed) will likely be set in about 2 months (that’s 9/15/2022 - mark your calendar).
Again, I’m not an attorney. Please let me know if any of the above is inaccurate or incomplete, and I’ll edit this post accordingly.
