They don't explain his ability it's basically anyone he touches dies(insta kill) and doesn't have to be skin to skin contact some theories say how if the person has sinned before then he can judge them with his ability therefore allowing him to kill them but we still don't really know his ability to this day

I think his ability allows him to choose what a persons crime is and then their punishment.Example when he said that his crime was breathing,the punishment he chose to give him was death.That’s why I feel like that follows how he can kill them without touching them.
